Terms for Nebula 100

“The Supplier” – Beyond Your Brand Limited (referred to as BYB), its agents and employees

“The Client” – The party signed up with The Supplier for the delivery of services that may include, but not be limited to, web design, development, hosting, marketing, SEO services, analytic services, and growth consulting.

  1. These Terms and Conditions are subject to modification and may undergo updates periodically. Any alterations will be communicated via email to the address provided at the commencement of The Agreement.
  2. Any failure or delay by any party in exercising its rights under these Terms and Conditions shall not be construed as a waiver of any of those rights.
  3. The Supplier reserves the right, at its discretion, to engage approved subcontractors under its supervision for any or all work, as deemed appropriate and necessary.
  4. When the Client provides images, graphics, text copy, video, or any other media for use on the website, they assure that they possess the copyright for the content or have obtained proper permission from the copyright holder, enabling legal and reasonable use of the content on the website.
  5. The Supplier shall not bear responsibility for copyright infringement concerning any content provided by the Client, their representatives, or agents. The Client agrees to indemnify and absolve the Supplier, its agents, and subcontractors from any claims arising from the content provided to the Supplier.
  6. The Supplier conducts daily backups of all their websites within the hosting provider’s infrastructure.
  7. The Client bears full responsibility for the editorial content present on the website. They commit to indemnifying Nebula against any legal action, demand, or claim arising from the editorial content of the website.
  8. In order to maintain portfolio credentials and uphold relevant copyrights, the Supplier will include a “Website by Nebula” link in the footer of all websites they create. Additionally, the Supplier reserves the right to use images of the Client’s website in marketing and portfolio materials.
  9. When the Client consents to a website going live, they confirm that the design and development meet all their requirements. Any payment terms related to the “Launch” phase will be activated and invoiced according to the Supplier’s terms.
  10. The Nebula100 service entails a minimum 24-month commitment. Afterward, the Supplier requires 30 days’ notice for agreement cancellation.

    If the Client provides notice in accordance with the terms of this Agreement, the Client must settle any remaining balance for the 24-month term. Upon receiving notice, the Supplier will:

    a. Disable the website on an agreed future date, provided all due payments have been made. Upon completion of payment, the Agreement terminates, and the Supplier will remove the website from its servers.

    b. If the Client wishes to host the website with another provider or obtain ownership of the website files and content in full, the Supplier will charge a transfer fee of £375.
